Alabama doesn’t need nitrogen gas to execute Jeffery Lee tonight, but keeps fighting to use it.

The federal judge who ruled the nitrogen method cruel and unusual left two other methods available. Alabama appealed for the right to use the gas and lost again Wednesday night. Now the state is asking the Supreme Court. Lee’s jury voted for life imprisonment almost thirty years ago, but the trial judge overruled them using a practice the state later abolished.

Veterinary guidelines reject using this gas on most animals unless they are sedated first, and Alabama’s protocol includes no sedative. Alabama already has the right to execute Lee tonight. What it’s fighting for is the chance to do it in a way your local vet wouldn’t.
